ITG Brands, the brand owner of the famous Winston cigarettes, sustains its pursuit of civil and criminal contempt charges against Spencer, even after the museum’s closure. The company claims to be the rightful owner of anything that bears the Winston branding, a point of contention that has sparked multiple lawsuits over the past year. Amidst a flurry of legal action, Spencer argued that ITG Brands only acquired the cigarette packets, not any part of the Winston Sports Marketing subsidiary’s assets from 2003, when NASCAR and the subsidiary parted ways.

The escalating issue ignited further after ITG Brands alleged that Spencer had made disparaging remarks about them in mainstream and social media, grounding their request for contempt charges. ITG is further fanning the flames by charging that Spencer continues to sell Winston-branded merchandise from the defunct museum in violation of copyright laws and marketing restrictions. Spencer waves a caution flag declaring that these items are authentic, produced before 2003, corroborated by their banners, flags, and decals.
In a revving twist reminiscent of an unexpected pit stop, ITG further insists that the Spencer family could have kept the museum operational through a rebranding effort, pointing to the upcoming lucrative auction featuring a Dodge Daytona projected to fetch more than $750,000.
